mCharts Body — Terms of Service

Connetix Health is a "doing business as" (DBA) name of Connetix Corp, a company based in Colorado Springs, Colorado.
These Terms of Service ("Terms") govern your access to and use of the mCharts Body mobile application (the "App"), including any related services, features, and content provided by Connetix Corp, doing business as "Connetix Health" ("Connetix Health," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App. In addition, the App makes use of external services, which each have their own terms of service and privacy policies:
1. Google: when you click the info button (the letter ‘I’ with a circle around it) related to an item of health information or condition, we perform an embedded Google search and show the search results about conditions, medications, allergies, etc. Google sees each search as though it comes directly from you in a browser, and thus can associate the health information item, such as a medical condition, to you. You can independently disable this search if you don’t want Google to see your health information items when you click the info button. 2. Merck Manuals: view patient education material related to a condition or procedure. You can independently disable this search if you don’t want Merck to see your health information items when you click the info button . 3. mCharts Body Map: determines the body map location of a condition, so you can see your conditions at a glance on a human body map. mCharts logs this information for normal tracking and performance analysis, but does not share or sell this information to third parties. You can independently disable this search if you don’t want mCharts Body Map to see your health information items, in which case your conditions are not plotted on the body map. 1. Description of the Service
mCharts Body uses patented technology to help you visualize and organize your personal health information. The App displays medical conditions on a human body map, links conditions to AI-generated and patient-focused educational content on other sites, and lets you tag, filter, and summarize your conditions, allergies, and medications so you can prepare for discussions with your health care providers. The App incorporates data from Apple Health (HealthKit), including medical records you retrieve from health organizations, and you may also enter health information manually.
The App is a personal organization and information tool. It is not a substitute for professional medical advice, diagnosis, or treatment, and it is not a medical device. See Section 6 (Medical Disclaimer) below.
2. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the App on your own behalf. If you use the App on behalf of a minor or another individual (for example, as a parent, guardian, or caregiver), you represent that you are authorized to manage that person's health information and to agree to these Terms on their behalf.
If the App requires an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Health Data, Apple Health, and Connected Records
The App is designed to work with Apple's HealthKit framework. To get the most complete health summary, you may be prompted to authorize connections between Apple Health and your health care organizations, which Apple facilitates through its own "health records" features (accessible by searching your device settings or your browser for instructions on downloading records to Apple Health).
By connecting Apple Health or entering information manually, you understand and agree that:
● Data importation is provided through Apple's HealthKit APIs and is subject to Apple's own terms, privacy practices, and permissions model. We access only the data categories you authorize.
● Health records retrieved from third-party health organizations are supplied by those organizations, and we do not independently verify their accuracy, completeness, or timeliness.
● You are responsible for reviewing information you manually enter or import and for correcting or removing anything that is inaccurate or outdated.
● You may revoke the App's access to Apple Health at any time through your device's Settings app, and you may delete data you have entered within the App, as described in our Privacy Policy.
4. AI-Generated and Third-Party Educational Content
The App links your healthcare information to artificial intelligence tools, search, and patient-focused educational content to help you understand possible causes and treatment options. This content is provided by other sites and is provided for general educational purposes only.
● AI-generated content and search results may be incomplete, generalized, or, in rare cases, inaccurate. It is not personalized medical advice and has not been reviewed by a licensed clinician on a per-user basis unless expressly stated.
● Links to external or patient-focused resources point to third-party websites and services that we do not control. We are not responsible for the accuracy, availability, or content of third-party sites.
● You should independently verify any health-related information from the App or linked resources with a qualified health care provider before acting on it.
5. Acceptable Use
You agree not to:
● Use the App to store, submit, or share another person's health information without their consent or legal authority to do so;
● Attempt to reverse-engineer, decompile, or extract the App's underlying models, source code, or datasets, except as permitted by law;
● Use the App in a manner that violates any applicable law, including health-privacy laws in your jurisdiction;
● Interfere with, disrupt, or attempt to gain unauthorized access to the App's systems, servers, or data; or
● Use the App as the sole basis for a medical emergency response. If you are experiencing a medical emergency, call your local emergency number immediately.
6. Medical Disclaimer
mCharts Body DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. THE APP IS INTENDED TO HELP YOU ORGANIZE AND COMMUNICATE YOUR OWN HEALTH INFORMATION AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL JUDGMENT. ALWAYS SEEK THE ADVICE OF A PHYSICIAN OR OTHER QUALIFIED HEALTH PROVIDER WITH ANY QUESTIONS YOU MAY HAVE REGARDING A MEDICAL CONDITION. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU READ OR VIEWED IN THE APP.
7. Privacy
Our collection, use, and disclosure of your information, including health information imported via Apple Health or entered manually, is described in our Privacy Policy. By using the App, you consent to those practices.
8. Intellectual Property
The App, including its software, design, body-map visualizations, text, graphics, and trademarks, is owned by Connetix Health or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use. Your own health data remains yours; see Section 9 and our Privacy Policy.
9. Your Data and Content
You retain ownership of the health information you import or enter into the App ("Your Data"). You grant Connetix Health a limited license to host, process, and display Your Data solely to provide and improve the App's functionality for you, as described in our Privacy Policy. We will not sell Your Data.
10. Disclaimers of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF DATA. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY HEALTH DATA IMPORTED FROM APPLE HEALTH OR THIRD-PARTY HEALTH ORGANIZATIONS WILL BE COMPLETE, CURRENT, OR ACCURATE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONNETIX HEALTH AND ITS OFFICERS, EMPLOYEES, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, HEALTH OUTCOMES, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) TEN U.S. DOLLARS ($10).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Connetix Health from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, misuse of the App, or violation of any third party's rights, including rights related to health information you submit about another person.
13. Term and Termination
These Terms remain in effect while you use the App. You may stop using the App and delete your account and data at any time, as described in the App and our Privacy Policy. We may suspend or terminate your access if you violate these Terms or if required by law, and will provide notice where reasonably practicable.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means before the changes take effect. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles, except to the extent preempted by U.S. federal law.
